Information Notice pursuant to Articles 13 and 14 of EU Regulation 679/2016 (GDPR)

In accordance to the legislation on the processing of personal data set out in Legislative Decree No. 196 of 30 June 2003 (Personal Data Protection Code, hereinafter referred to, for brevity, “Privacy Code”), and to EU Regulation 679/2016 (General Data Protection Regulation, hereinafter “GDPR”), the below information are provided, based on the definitions set out in Article 4 of the GDPR, regarding the processing of data provided voluntarily.

2.1 – Data may be collected exclusively in the following ways: via the ‘Contact’ section by completing the relevant form at the following web address: https://miccinesi.com/contatti/
2.2 – The data collected in accordance with point 2.1 will consist of the information gathered via the form (name, email address included in the message). Such data shall be deemed to have been provided voluntarily by the Data Subject – including with regard to the lawfulness of their use where they do not relate to the Data Subject themselves – on the basis of the conclusive conduct consisting of completing the form or sending an email to the address studio@miccinesi.com.
2.3 – The data processed are primarily general personal data. Even where sensitive data are sent, these will be processed exclusively for the purposes set out in point 3.
2.4 – By entering their email address, the Data Subject declares that the Data Controller may lawfully use this data for the necessary purposes, indemnifying the Data Controller against any potential adverse consequences of any kind.

3. Purposes of processing and consequences of refusal
3.1 – The data voluntarily provided by the Data Subject in accordance with the procedures set out in point 2 will be used exclusively for the purpose of responding to the communication received.
3.2 – Consent to the provision of the aforementioned data is not mandatory. Refusal – whether total or partial, incorrect or untrue – may result in the Data Controller being unable to provide an adequate and correct response.
3.3. Consent may be withdrawn at any time by the data subject.

4. Methods of processing
4.1 – The data will be processed electronically. Data processing will be carried out in accordance with the principles of fairness, lawfulness, transparency, protection of confidentiality and the rights of the data subject, in full compliance with current legislation.
4.2 – For purely organisational and operational purposes, we have appointed certain service providers responsible for the management of the Website as external data processors for the processing of users’ personal data for purposes strictly connected and related to the management of the Website. The names of these external data processors may be requested by contacting us at the details provided.

5. Scope of access by the Data Controller’s organisational structure
Within the Data Controller’s organisational structure, access to the data subject’s personal data may be granted to individuals expressly appointed as data processors or data controllers in relation to the aforementioned purpose.

6. Scope of data circulation: disclosure and communication
The personal data covered by this privacy notice will not be disclosed or communicated to third parties.

7. Rights of data subjects and procedures for erasure
Data subjects are entitled at any time to exercise their rights as set out in Articles 15 to 22 of the GDPR, which include, amongst others, the right to request from the data controller “access to personal data and the rectification or erasure of such data, or the restriction of processing concerning them, or to object to their processing, as well as the right to data portability”.

8. Duration of processing
Processing will last for the time strictly necessary to respond to the email and, where applicable, to establish communication with the sender, without prejudice to any processing operations carried out after the relationship has ended and arising from obligations under current legislation.

9. Obligations and declarations of the data subject
For all legal purposes, the data controller acknowledges that the data subject, having read, understood and fully accepted this privacy notice, has consciously and voluntarily provided the data, guaranteeing its lawfulness, accuracy, integrity, truthfulness and the right to dispose of it, and fully exempting the data controller from any related claims of any nature arising from third parties.
No liability may be attributed to the Data Controller should the data provided not be lawful, accurate, complete or truthful. In this regard, the Data Subject hereby waives any and all claims against the Data Controller in this matter.
The sending of the email shall be deemed conclusive evidence of acknowledgement, understanding and acceptance of this clause, as well as an indemnity and waiver for all legal purposes.
